The Board of Directors of PETONE wishes to announce that the Plaintiff, through its lawyers served the Writ of Summons dated 15 October 2012 on the Defendant, a wholly-owned subsidiary of PETONE, at the registered address of PETONE on 16 October 2012. The Writ of Summons arose from an allegation of default in payment of a term loan facility (“Term Loan”) by the Defendant due to RHB Bank (L) Ltd, the lender of the Term Loan (“Lender”). To secure the Term Loan, the Defendant had amongst others, executed a mortgage which was duly registered in accordance with the Merchant Shipping Ordinance, 1952, where the Defendant, as a mortgagor, mortgaged a ship or vessel known as “Taurus” (IMO No. 7917915/Registry No. 332422) (“Vessel”) to the Plaintiff as mortgagee and security agent for the Lender (“Mortgage”). Pursuant to the above and the Statement of Claim (“Claim”), the Plaintiff is now claiming for the following:
The Board of PETONE is of the opinion that if the Claim succeeds, there is no other financial impact of the Claim on PETONE and its subsidiaries other than the Sum of Claim and the Costs. The expected losses arising from the Claim, should it be successfully made against the Defendant, will be up to the Sum of Claim and the Costs. The Defendant is currently seeking legal advice with regards to the above Writ of Summons and Claim. Further development of the above litigation will be announced on Bursa Malaysia Securities Berhad in due course. This announcement is dated 17 October 2012. | |
