The terms used herein, unless the context otherwise states, shall bear the same meaning as those defined in the announcement dated 19 July 2012 in relation to the Proposed Acquisition. On behalf of the Board, OSK wishes to announce that Nautical Icon and SSK Logistics had, on 20 September 2012, mutually agreed vide a supplementary letter dated on even date to vary the following payment terms under the sale and purchase agreement in relation to the Proposed Acquisition ("SPA"):- (a) notwithstanding the condition of payment as stated in Clause 5.3(a) of the SPA, Nautical Icon will pay the sum of Ringgit Malaysia One Million Eight Hundred Thousand (RM1,800,000.00) to the Chargee Bank as required in the Chargee Bank's redemption statement, subject always to Clause 5.2(b) of the SPA; and Save for the above, all the other conditions, covenants, provisions and terms contained in the SPA shall remain valid and enforceable.
