Further to our announcement to Bursa Malaysia Securites Bhd on 04/06/2012, the Board of the Company hereby announces that Harrisons Trading (Sabah) Sdn Bhd (“HTSB”) had received a letter from Kastam DiRaja Malaysia (“Kastam”) dated 19/09/2012 in reply to HTSB’s letter of 09/07/2012. HTSB had by their letter of 09/07/2012 explained to Kastam the various business models of HTSB and why HTSB is not liable for any customs duties, excise duties and sales tax totaling RM91,750,418.99 previously demanded by Kastam in their letter dated 15/02/2012. Kastam had responded to HTSB’s letter of 09/07/2012 and repeated their opinion that HTSB is liable to pay the amount previously demanded and that HTSB has allegedly breached provisions of the Customs Act 1967 and by extension, a provision of the Anti-Money Laundering And Anti-Terrorism Financing Act 2001(“AMLA”). Kastam went on to advise HTSB to settle the amount demanded within 14 days from 19/09/2012 failing which Kastam will propose that civil and criminal action be taken against HTSB. HTSB maintains their stand that HTSB is not liable to pay Kastam the amount demanded nor breached any provisions of the Customs Act 1967 nor AMLA as alleged or at all. HTSB is in the process of obtaining legal advice on the options available to HTSB in the light of Kastam’s letter of 19/09/2012.
