Reference is made to the announcement made by Emas Kiara Industries Berhad (“EKIB”) on 5 June 2012 and subsequent announcements on Suit No. 22NCVC-722-06/2012 between Emas Kiara Sdn Bhd (“Plaintiff”), Lembah Beringin Sdn Bhd (Receivers and Managers Appointed) (In Liquidation) (Company No. 243726-P) and its Receivers and Managers i.e. Michael Joseph Monteiro (NRIC No. 390207-10-5405) and Heng Ji Keng (NRIC No. 471010-01-5435) (“Defendants”), and Farcoll Estate Sdn Bhd and seven (7) others (“Interveners”). EKIB wishes to update the following pursuant to the Case Management on 28 August 2013:- 1) The Interveners vide solicitors suggested to include the correspondences and emails between the Defendants and the Interveners in relation to the purchase of Properties in the Common Bundle of Documents of the Plaintiff, Defendants and Interveners. The Plaintiff’s solicitors has placed an objection as to the above and thereafter, the Deputy Registrar suggested the Plaintiff to write a letter to the Honourable Judge and seek a new Case Management date to resolve the above issue. 2) The Deputy Registrar has fixed 11 September 2013 as the next Case Management date for the parties to file further Common Bundle of Documents of the Plaintiff, Defendants and Interveners and List of Witnesses to the Court. 3) The Court has fixed the hearing of the matter on 6 November to 8 November 2013.
