Astro Malaysia Holdings Berhad (the “Company”) wishes to update the Exchange on the status of the appeal by AV Asia Sdn Bhd (“AV Asia”) at the Federal Court against the dismissal of the interlocutory injunction, where MEASAT Broadcast Network Systems Sdn Bhd ("MBNS"), a wholly-owned subsidiary of the Company, is the Respondent. It was previously reported in the Company’s Prospectus dated 21 September 2012 that AV Asia had failed in its application for an interlocutory injunction at the High Court and the Court of Appeal. The application was made to restrain MBNS from making use of any alleged confidential information supplied by AV Asia and from supplying to MBNS’ customers, whether directly or indirectly, any satellite dishes in the manufacture of which any such alleged confidential information has been used. In August last year, the Federal Court had granted AV Asia leave to appeal against the dismissal of the interlocutory injunction and the appeal was initially fixed for hearing at the Federal Court on 3 October 2013. The hearing was then brought forward to 29 August 2013. We wish to announce that the Federal Court has dismissed AV Asia’s appeal with costs. The background of this matter is referred to in Section 15.7 (i) of the Prospectus of the Company dated 21 September 2012 in relation to the claims brought by AV Asia against MBNS and another party.
