Contents: Referring to our previous announcement dated 12 November 2010, the Company wishes to announce that the Court of Appeal had on 16 November 2010 unanimously allowed the Company's appeal against the decision of the Senior Assistant Registrar in dismissing the Company's application to strike out the Plaintiff's derivative action that was commenced against the Company.
The Court of Appeal was of the view that the Statement of Claim clearly indicates that the civil suit is one of a breach of the Joint Venture Agreement and there is no basis for the derivative action and the damages suffered by the Plaintiff is a result of the breach of the Joint Venture Agreement.
