The Board of Directors of Daya Materials Berhad ("DMB") wishes to announce that Daya OCI Sdn Bhd (Formerly known as OCI Energy Sdn. Bhd.) ("OCI"), a wholly-owned subsidiary of DMB had in an inter partes hearing on 27 August 2010 obtained an order of phohibitive injunction from the Court against COE Drilling (Asia) Sdn Bhd as the first defendant and AmBank Berhad as the second defendant.
The said order of prohibitive injunction restrains the first defendant from making any demand on the second defendant under the bank guarantee dated 12 March 2009 (extended to expire on 30 August 2010) given by the second defendant to the first defendant as the beneficiary.
The said order of prohibitive injunction further restrains the second defendant from paying the first defendant any money under the said bank guarantee.
