Further to the changes in the material litigation between Bandar Subang Sdn Bhd (“BSSB”), a wholly-owned subsidiary and Cygal Berhad in respect of the arbitration of the building contract since the date of the last annual statement of financial position as set out in the financial results for the fourth quarter ended 31 December 2012, Farlim wishes to announce that BSSB had on April 8, 2013 received from the Arbitrator a Consent Award dated March 25, 2013 wherein BSSB shall pay to the claimant Cygal Berhad a total sum of Ringgit Malaysia Nine Million (RM9,000,000.00) Only, of which Ringgit Malaysia Three Million (RM3,000,000.00) had been paid, Ringgit Malaysia Three Million and Five Hundred Thousand (RM3,500,000.00) is payable not later than by January 27, 2014 and Ringgit Malaysia Two Million and Five Hundred Thousand (RM2,500,000.00) payable not later than by January 27, 2015 as full and final settlement of a claim by Cygal Berhad for Ringgit Malaysia Eighteen Million Six Hundred Fifty-Three Thousand Four Hundred and Sixty-Three (RM18,653,463.00) Only with interest for alleged breach by BSSB of a building contract dated April 8, 1998 for construction by Cygal Berhad of condominiums and clubhouse at Lot 14252 (PT9262), Mukim Damansara, Daerah Petaling, Selangor Darul Ehsan. Irrevocable and unconditional on demand personal guarantee and indemnity of Tan Sri Dato' Seri Lim Gait Tong, Puan Sri Datin Seri Chin Chew Lin and Mr Lim Chu Dick were provided to Cygal Berhad for the guaranteed principal sum of RM6,000,000.00 each in relation to the above full and final settlement. An irrevocable and unconditional on demand corporate guarantee and indemnity of Farlim for the guaranteed principal sum of RM6,000,000.00 was also provided to Cygal Berhad.
