Pursuant to Paragraph 9.04(f) of Bursa Malaysia Securities Berhad’s Listing Requirements (“Bursa Securities LR”), the Board of Directors wishes to announce that the Company and two (2) of its wholly-owned subsidiaries: (a) Weida Resources Sdn Bhd (“WRSB”); and (b) Weida Integrated Industries Sdn Bhd (“WIISB”), have on 11 November 2014, been served an Originating Summons, an affidavit by Md Nayan bin Salleh affirmed on 22 September 2014, affidavit by Tay Chee Teok affirmed on 22 September 2014, affidavit by Md Nayan bin Salleh affirmed on 29 October 2014 and affidavit by Tay Chee Teok affirmed on 29 October 2014 and an order dated 5 November 2014 [“said OS action”] by (a) Md. Nayan Bin Salleh (NRIC No. 541209-02-5877) (“1st Plaintiff”); and (b) Pujatasara Sdn Bhd (Power of Attorney holder of the 1st Plaintiff) (“2nd Plaintiff”), through their solicitors, Messrs Maja & Associates, in the High Court in Sabah and Sarawak at Kuching vide Originating Summons No. KCH-24IP-1/9-2014(HC1). The salient point of said OS action is: “the Company, WRSB and WIISB, their agents, servants or any of them or otherwise, be restrained by way of an injunction from offering to sell, selling or installing the product called “POLYTRAP” which infringes the patent rights of the 1st Plaintiff in respect of a Grease Trap product which is patented under Patent No. MY-135509-A under the Patents Act 1983.” Upon
receiving advice from the Company’s solicitors, the Company is of the view that
there is a strong basis to defend the injunction vigorously. The
said OS action has been fixed for hearing on 21 November 2014. The Company has
appointed Messrs Ibrahim & Co Advocates to act on its behalf in the said OS
action.
Further development of the above litigation will be announced on Bursa Malaysia Securities Berhad in due course.
