| Description | KEJURUTERAAN SAMUDRA TIMUR BERHAD ("KSTB" OR "THE COMPANY") - STATUTORY NOTICE PURSUANT TO SECTION 218(2)(A) OF THE COMPANIES ACT, 1965 |
We act for and on behalf of KSTB. Further to the announcements made on 13 February 2014 and 26 February 2014, the Board of KSTB (or "Plaintiff") wishes to inform that Tesco Singapore Pte. Ltd ("Defendant") had informed the Court on 27 February 2014 that they wish to reply to the Affidavit in Support of the Notice of Application (Injunction) dated 21 February 2014 filed by Messrs. Cheah Teh & Su on behalf of the Plaintiff. The Defendant’s solicitors have consented to an ad interim injunction pending disposal of the injunction application in the terms of the Notice of Application. This means that pending the disposal of the injunction application, the Defendant is restrained from presenting a winding-up petition against the Plaintiff upon expiry of the Section 218 notice which expires on 3 March 2014. The Court also gave the following directions:- i) The Defendant to file its affidavit in reply by 7 March 2014; ii) The Plaintiff to file its affidavit in reply by 14 March 2014; and iii) Both Defendant and Plaintiff to file their respective written submissions on or before 21 Mach 2014. The court fixed 28 March 2014 at 10:30 a.m. for hearing of the injunction application as well as case management of the Originating Summons No.: 24NCC-61-02/2014.
