The abbreviations used in this announcement are consistent with that used in the earlier announcements. On behalf of AYS, HLIB wishes to announce that AYS had on 9 September 2014 notified the Securities Commission Malaysia (“SC”) that AYS is deemed to have complied with the Bumiputera Equity Condition pursuant to the terms and conditions as set out in the approval letter dated 19 June 2013 from the SC for the Special Issue. In view that the Special Issue was previously undertaken to facilitate the compliance of the Bumiputera Equity Condition, the Board has decided not to proceed further with the Special Issue and accordingly terminates the Special Issue with immediate effect. This announcement is dated 11 September 2014.

On 11.09.2014, the Court of Appeal granted a conditional stay on the basis that Kinsteel make payment of the sum of RM4,500,000.00 into a joint solicitors interest bearing account within 14 days from 11.9.2014 (by 25.9.2014). 1. Introduction Spektrum Kukuh Sdn. Bhd. (“SKSB”), a 70% owned-subsidiary of Tanjung Piai Maritime Industries Sdn. Bhd., which in turn is a wholly-owned subsidiary of Benalec Sdn. Bhd., which in turn is a wholly-owned subsidiary of Benalec, had on 12 March 2013 entered into a binding term sheet (“Term Sheet”) with The State Secretary, Johor (Incorporated) (“S.S.I.”) and 1MY Strategic Oil Terminal Sdn Bhd (“the Purchaser”) to undertake the reclamation works and sale of approximately 1,000 acres of land off the coast of Tanjung Piai, Johor Darul Ta’zim (“the Land”) for the purpose of constructing and operating a crude oil and petroleum storage facility together with a private jetty (“Project”). (SKSB, S.S.I. and the Purchaser are collectively referred to as “the Parties”.) 2. Status Further to the announcements made on 12 March 2013, 12 June 2013, 17 June 2013, 11 September 2013, 12 December 2013, 19 March 2014 and 12 June 2014 with regards to the Term Sheet, the Parties are in the midst of finalising the terms and conditions of the Sale and Purchase Agreement.
