We refer to the announcements made on 4 January 2013, 30 September 2013 and 3 April 2014 in respect of the Proposed Subscription. The Company wishes to announce that following from the issuance of the notice of demand dated 3 April 2014 by the Company’s solicitors to NSERC, NSERC has to date refused, neglected and/or failed to refund and reimburse the sum of RM3.8 million being the earnest deposit duly paid by the Company to NSERC (“Earnest Deposit”) either in full or in part. Accordingly, the Company has instructed its solicitors to commence legal proceedings against NSERC for the recovery of the Earnest Deposit and a Writ of Summons was filed against NSERC on 4 June 2014. The legal suit is not expected to have any material adverse impact on the Company’s and the Group’s financial position and performance for the financial year ending 31 December 2014.
