1. Introduction

Country View Berhad (CVB) wishes to announce that Country View Resources Sdn Bhd (CVR), a wholly owned subsidiary has on 5 April 2013 been served with a Writ of Summons dated 22 March 2013 through CVR’s solicitors by Messrs. Tam Cheng Yau & Co., solicitors for 174 owners/residents of a housing area located at Kiara Hills, Taman Nusa Indah, Nusajaya, Johor.

This suit arises from two previous suits nos 23NCvC-174-09/2011 and 23NCvC-88-06/2012 which had previously been announced on 16 November 2011 and 20 July 2012. The said suits had previously been struck off on 14 February 2012 and 8 March 2013 respectively by the Johor Bahru High Court with liberty to file afresh.

2. Circumstances leading to the Writ of Summons

In the Writ of Summons it was stated as follows:

a) The Plaintiffs are at all material time 174 owners and residents of a housing area located at Kiara Hills, Taman Nusa Indah, Nusajaya, Johor.

b) The 1st Defendant is at all material time a private company established under the Companies Act, 1965 and had in 2009 started construction of 2 units of water reservoirs, a suction tank, a pump house and a switch station which is named as Medini Utility 2 Reservoir (MED/UT2), Taman Nusa Indah, Nusajaya, Johor which is near the houses and the properties of the Plaintiffs (hereinafter referred to as Lot PTD 116768).

c) The 2nd Defendant is the local enforcement authority for the area of Johor Bahru Tengah, Johor.

d) CVR, the 3rd Defendant is at all material time a registered licenced housing developer and is the developer of Kiara Hills, Taman Nusa Indah, Nusajaya, Johor.

e) The 1st Defendant and its agents had proceeded with explosive works (blasting and earthworks) for levelling a hill on Lot PTD 116768 which is adjacent to the Plaintiffs’ residences.

f) As a result of the construction and explosive works (blasting and earthworks) of the 1st Defendant the Plaintiffs claimed against the 1st, 2nd and 3rd Defendants for damages and other reliefs.

g) The Plaintiffs are also claiming that CVR:

i. Gagal untuk memastikan bahawa pembinaan hartanah di Kiara Hills, Nusajaya adalah selamat bagi penghuni-penghuni termasuk Plaintif-Plaintif;

ii. Gagal untuk memastikan pembinaan hartanah Plaintiff-Plaintiff tidak menghadapi kerosakan “latent”

iii. Gagal untuk menggunakan material binaan yang bermutu dan berkualiti di dalam pembinaan projek perumahan Kiara Hills, Taman Nusa Indah sehingga menyebabkan kerosakan ‘latent’ seperti keretakan sewaktu kerja-kerja pembinaan tangki air oleh Defendant Pertama.

iv. Gagal untuk mengkaji dan mengambil tindakan sewajar terhadap struktur tanah kawasan perumahan Plaintif-Plantif sebelum memulakan pembinaan hartanah Plaintif-Plantif.

v. Gagal untuk memastikan “piling” dan/atau “footing” bagi hartanah Plaintif-Plaintif adalah pada tahap yang berpatutan dan mampu bertahan untuk jangkamasa yang panjang

vi. Gagal memastikan bahawa terdapatnya “piling” dan/atau “footing” yang mencukupi yang mampu tahan kegegaran dan/atau “land settlement” akibat letupan-letupan dan/atau yang berkenaan kerja-kerja yang dilakukan oleh Defendan Pertama.

vii. Gagal menasihati Defendan Pertama dan/atau memberitahunya tentang tahap “maximum kegegaran yang mampu di tahan oleh “piling” dan/atau “footing” tapak perumahan di kawasan dan hartanah Plaintif-Plaintif tersebut;

viii. Gagal memberitahu dan/atau menasihati Defendan Kedua dan/atau menyokong Defendan Kedua dengan pelan-pelan “Professional Engineer” tentang keadaan “piling” dan atau “footing” di hartanah tersebut samada ia mampu tahan gegaran yang berterusan seumpama yang dilakukan oleh Defendan Pertama tersebut;

ix. Gagal memastikan bahawa “standard” pembinaan kawasan tersebut oleh Defendan Ketiga mampu mengambilkira dan/atau tahan letupan dan pembinaan seumpama yang dilakukan oleh Defendan Pertama atau gegaran lain yang seumpama/sekuat yang berlaku pada tapak kawasan tersebut;

x. Gagal memastikan bahawa tapak perumahan di kawasan tersebut mampu menahan “settlement” yang telah diakibatkan gegaran yang ditimpa kepada Plaintif-Plaintif;

xi. Secara am gagal memastikan bahawa gegaran dan/atau “consequence” kerja-kerja Defendan Pertama tersebut membawa kesan yang minima kepada tapak kawasan dan hartanah tersebut.

h) The Plaintiffs claimed for various declarations, orders, injunction and damages plus other reliefs against the 1st Defendant, 2nd Defendant and CVR, as the 3rd Defendant under the Writ of Summons.

i) The Plaintiffs further claim:

a) interest at the rate of 4% per annum on general damages from the date of filing the Summons to the date of full settlement;

b) interest at the rate of 4% per annum on special damages from the date of filing summons to the date of full settlement; and

c) interest at the rate of 5% per annum on the Judgment sum from the date of Judgment to the date of full settlement.

3. Information on CVR

CVR was incorporated on 17 August 2000 and is a wholly-owned subsidiary of CVB. Over the years, the total cost of investment in CVR as per the latest Audited Financial Statements as at 30 November 2012 is RM2.5 million, being equity capital subscribed by CVB.

Based on the Latest Audited Financial Statements as at 30 November 2012, CVR is considered a major subsidiary.

4. Steps proposed to be taken

CVB and CVR have instructed its solicitors to take all appropriate legal actions with a view to defend the interest of CVR in the matter.

The suit has been fixed for case management on 22 April 2013.

5. Financial and Operational Impact

At the present moment, the likely outcome of the suit/action cannot be ascertained but there is a possibility that CVR can be held liable but the amount of liability cannot be reliably measured until the determination of the suit/action. As such, the financial, operational impact and expected losses if any arising from the Summons cannot be determined at this moment.
