The Board of Directors of Y&G wishes to announce that the Company had on 23 January 2013 received a Letter of Demand dated 17 January 2013 from Messrs MG’s Legal Chambers, acting for Lembaga Pembangunan Perumahan Dan Bandar (“LPPB”), demanding payment for a sum of RM1,767,052.00 (“the Demanded Sum”) being the guaranteed amount made by the Company pursuant to a Corporate Guarantee Agreement dated 5 August 2003 following the failure on the part of Sierra Estates Sdn Bhd (“SESB”) (a former deconsolidated subsidiary of Y&G) in fulfilling the terms and conditions stated in the Second Supplementary Agreement dated 5 August 2003. Y&G has been demanded to pay the aforesaid Demanded Sum within thirty (30) days from the date thereof, failing which, legal action will be filed against the Company. The Directors are of the opinion that the Demanded Sum does not have a material financial/operational impact on the Group and the management has been instructed to look into negotiating for an amicable settlement with LPPB. Further announcement on the material development of the above matter will be made in due course. This announcement is dated 25 January 2013.

The Board of Directors of TIGER SYNERGY BERHAD (“the Company”) wishes to update the Exchange on the following legal cases of the subsidiaries of the Company:- (a) A legal action was initiated against Janavista Sdn Bhd, a wholly owned subsidiary of the Company by Yeo Ping Tieng and Biaxis Sdn Bhd for a declaration that the Sale and Purchase Agreement dated 4.4.2006 is valid and Yeo Ping Tieng is the legal owner of the property. The plaintiff further claim a sum of RM261,719.84 and interest of 8% per annum being liquidated damages for failure to deliver vacant possession. The case is fixed for trial on 13/01/2014 to 17/01/2014. (b) A legal action has been instituted by a third party against a wholly-owned subsidiary company, Janavista Sdn Bhd. for trespassing and encroaching into the land owned by the third party which is located beside the development project of the subsidiary company. The court has fixed on 30/01/2013 for the case management of assessment of damages. (c) A legal action was initiated against Janavista Sdn. Bhd. (JSB), a wholly owned subsidiary of the Company by Poon Tak Woo Mark (PTW) for breach of the Sale and Purchase Agreement dated 29.10.2004 for the sales of 4 units of bungalow lots. The case be remitted to High Court for trial on merits. The case is fixed for trial on 4 January 2013 and pending for decision. (d) A legal action was taken by Wong Yu Chiu (WYC) against Janavista Sdn. Bhd. (JSB), a wholly owned subsidiary of the company for the sum of RM391,503.31 being liquidated damages and interest of 8% per annum for failure to deliver vacant possession. Plaintiff’s application for summary judgment has been granted. A winding-up petition has been served by Wong Yu Chiu for the claim of RM488,896.43 and the winding-up petition has been withheld as parties have reached an amicable settlement and the winding-up petition will be withdrawn. (e) A legal action was initiated against Janavista Sdn. Bhd., a wholly owned subsidiary of the Company by Lim SiewTeck for the sum of RM109,158.00 together with specificperformance and damages. The trial date is fixed on 29/1/2013, 30/1/2013 and 31/1/2013. (f) A legal action was initiated against Janavista Sdn. Bhd., a wholly owned subsidiary of the company by CIMB Bank Berhad for a declaration that the Sale and Purchase Agreement dated 20/10/2006 is valid and Lee Won Keng and Mah Mun Pein are the legal owner of the property together with an injunction to refrain the defendants to sell, charge and/or transfer the subject property. The case is fixed for trial on 28/03/2013 & 29/03/2013. (g) A legal action was initiated against Janavista Sdn. Bhd., a wholly owned subsidiary of the company by CIMB Bank Berhad for a declaration that the Sale and Purchase Agreement dated 16/11/2006 is valid and Muhammad Amin Cheoh Bin Abdullah is the legal owner of the property together with an injunction to refrain the defendants to sell, charge and/or transfer the subject property. The case is fixed for trial on 28/03/2013 & 29/03/2013. (h) A legal action was initiated by Kerajaan Malaysia against Janavista Sdn Bhd (JSB), a wholly owned subsidiary of the Company for the sum of RM598,481.92 being income tax payable by JSB for the year of 2008.
