Contents: We refer to our announcement dated 5 July 2010 in relation to the Winding-Up Petition.
Please be informed that the Company had served Affidavit in Opposition to Petition (No. 2) dated 24 August 2010 to oppose the Winding-Up Petition fixed for hearing in High Court II at Kota Kinabalu on 3 September 2010 at 9 am on Syarikat Neptune's Advocates, Messrs Chin Lau Wong & Foo on 26 August 2010 ("Affidavit"). The objections in the Affidavit hereof are meritorious.
Consequently, Messrs Chin Lau Wong & Foo, had to apply to court to vacate the hearing as they have not complied with the re-advertisement of the Winding-Up Petition in the gazette. Syarikat Neptune has also not complied with Rule 32(1)(a) of the Companies (Winding-Up) Rules, 1972.
With the above non-compliance, it is not possible for Syarikat Neptune to proceed with the hearing of the Winding-Up Petition, and the adjournment thereof is inevitable. With the above development, the Company had been advised by its solicitors that there is no immediate need to file any application to stay the proceedings, but the same could still be considered at a later stage.
