Further to the Company’s announcement on 5 June 2014 in respect of the Proposed Subscription, the Company wishes to announce that the parties in the abovementioned suit have on 24 November 2014, recorded a Consent Judgement in the aforesaid matter before the High Court of Malaya at Temerloh.
Based on the terms of the said Consent Judgement, NSERC will pay to the Company the sum of RM3,800,000.00 by way of 3 instalments, inter alia, as follows:
(i) the first instalment in the sum of RM1,000,000.00 is to be paid vide a post-dated cheque dated 31 December 2014;
(ii) the second instalment in the sum of RM1,300,000.00 is to be paid vide a second post-dated cheque dated 28 February 2015; and
(iii) the third instalment in the sum of RM1,500,000.00 is to be paid vide a third post-dated cheque dated 30 April 2015.
The legal suit is not expected to have any material adverse impact on the Company’s and the Group’s financial position and performance for the financial year ending 31 December 2014.
