Description	DAMANSARA REALTY BERHAD – (“DBhd” or “The Company”) : - UPDATE ON THE OUTCOME OF THE DECISION OF THE HIGH COURT IN RELATION TO THE MATERIAL LITIGATION
Reference is made to the announcement dated 8 October 2013 in respect of material litigation between the Company and Bungsar Hill Holdings Sdn. Bhd. (“BHH”) pertaining to interest on land acquisition compensation monies. BHH had on 26 May 2014 served on the Company two Notices pursuant to Section 218 of the Companies Act 1965 for the sum of RM6,303,373.39 and RM208,101.08 respectively (“the said Notices”). On 13 June 2014 the Company filed an action against BHH vide Kuala Lumpur High Court Originating Summons No. 24NCC-217-06/2014 (“the OS”) for declaratory and final injunctive reliefs (among others) and on 16 June 2014 upon the Company’s ex-parte application vide a Notice of Application dated 13 June 2014 for interim injunctive reliefs (among others) filed under the OS, the Kuala Lumpur High Court made an ex-parte interim injunction Order in terms of the following:- (1) BHH, either by itself and/or by its servants and/or its employees and/or its agents or otherwise be restrained from presenting a winding-up petition pursuant to the Companies Act 1965 against the Company premised upon the said Notices pending the final disposal of the OS or until further order, upon the Company’s undertaking to abide by any Order the Court or Judge may make as to damages in the event the Court or Judge should hereafter be of the opinion that BHH may have sustained by reason of the Order made herein and which the Company ought to pay; (2) parties be at liberty to apply; (3) the Company’s said Notice of Application and the OS be heard inter-partes by the Judge on 30 June 2014 at 3:30pm; and (4) the costs of the Company’s ex-parte application for the Order herein and incidental thereto be costs in the cause. According to procedural rules, the above ex-parte Order is effective for 21 days from 16 June 2014. This announcement is dated 19 June 2014.
