The Board of Directors of Hytexin wishes to inform that the Company and its wholly-owned subsidiary, Hytex Apparels Sdn Bhd (“HASB”) have received the Writ of Summon dated 6 November �2012 from United Overseas Bank (Malaysia) Berhad (“the Plaintiff”). 1.�������������� The date of the presentation of the Writ of Summons and the date of the Writ of Summons. The Writ of Summons and Statements of Claim both dated 6 November 2012 were served on 9 November 2012. 2.�������� The particulars of the claim under the Writ of Summons, including the amount claimed for and the interest rate. The Plaintiff's claims are as below:- (a)������� The sum of RM6,617,560.83; (b)������� interest on the sum of RM6,617,560.83 at the Plaintiff’s Base Lending Rate [“BLR”] which as at 1 October 2012 is 6.60% per annum (and such BLR which may be determined by the Plaintiff from time to time) + 3.50% per annum on monthly rest form 1 October 2012 until the date of full settlement; (c)������� cost against the 1st Defendant on full indemnity basis; (d)������� cost against the 2nd Defendant on full indemnity basis; (e)������� such further or other relief as the Honourable Court deems fit and proper to grant. 3.������� The details of the default or circumstances leading to the filing of the Writ of Summons. Hytexin did not proceed with the Restructuring Agreement dated 22 October 2010 which resulted in the default. 4.�������� The financial and operational impact of the Writ of Summons on the Hytexin Group. Full and immediate repayment of the outstanding sum would have dire financial and operational impact on Hytexin Group. 5.�������� The expected losses, if any, arising from the Writ of Summons. ����������� Save for the interest payable and legal cost involved, there would be no other losses. � 6.�������������� The steps taken and proposed to be taken by the Company in respect of the Writ of Summons. Hytexin have appointed AmInvestment Bank Berhad on 31 October 2012 to undertake a restructuring of the Group’s debts. AmInvestment Bank Berhad is now working on a proposal for submission and discussion with the various lenders.
