Contents: We refer to our announcement on the status of application for the Certificate of Fitness for Occupation ("CFO") dated 25 March 2010.
KHIB's appointed engineer, via its letter dated 24 June, 2009, had submitted the amended building plan together with other approvals from all relevant authorities, to Majlis Perbandaran Subang Jaya ("MPSJ").
KHIB appointed engineer, via its letter dated 25 September 2009 and 28 October 2009, had appealed for the waiver of certain conditions imposed by MPSJ, via its letter dated 12 August 2009.
MPSJ, via its letter dated 21 December 2009 but issed on 28 April 2010, has waived certain condition imposed previously. However, MPSJ, via its letter dated 17 May 2010, had also imposed additional requirement on the proposed building plan.
KHIB appointed Architect is in the midst of amending the building plan to comply with the additional requirement. The building plan approval from MPSJ is still pending.
In view of the MPSJ's building plan approval which is not forthcoming and additional conditions being imposed, whilst SC's time extension approval which is only up to 7 November, 2010, KHIB board strongly believes that it is unable to meet the dateline, having only less than 5 months to secure the building plan approval, construct the factory and to obtain CFO at the same time.
In addition, pursuant to KHIB annoucement on 8 June 2009 and undertaking letter to SC dated 20 May 2009, KHIB has undertook to vacate the rented property in the event that the CFO cannot be obtained by 7 November 2010.
Thereby, considering tha factors involved and timeline constraint, the board of director of KHIB has deliberated and agreed that KHIB has no other option but to terminate the rental agreement with T.C. Yap Holdings Sdn. Bhd. ("TCY") and vacate the property, and in doing so, giving TCY, a 3 months notice in advance for the termination of rental agreement, which will be put into effect on this date.
