W-02-541-2003 (heard together with W-02-510-2003)
The Court of Appeal allowed the appeals with costs with RM100,000 to be paid to each Appellant, that is, Harrisons Trading (Sabah) Sdn. Bhd., Harrisons Trading (Sarawak) Sdn. Bhd. and Kumpulan Jaya Pemasaran Sdn. Bhd. and that the Judgment dated 12 June 2003 against the Appellants is set aside and the counterclaim is allowed.

This is Zaitun's appeal against the setting-aside of the ex parte Order dated 17 July 2003 obtained by Zaitun for leave to issue committal proceedings against Harrisons Trading (Sabah) Sdn. Bhd., Harrisons Trading (Sarawak) Sdn. Bhd., Harrisons Trading (Peninsular) Sdn. Bhd., Kumpulan Jaya Pemasaran Sdn. Bhd. and their respective directors.
The Court of Appeal dismissed Zaitun's appeal with costs of RM30,000 to be paid to each respondent, that is Harrisons Trading (Sabah) sdn. Bhd., Harrisons Trading (Sarawak) Sdn. Bhd., Harrisons Trading (Peninsular) Sdn. Bhd. and Kumpulan Jaya Pemasaran Sdn. Bhd. The deposit of RM500 paid by Zaitun Marketing Sdn. Bhd. when the appeal was lodged is to be paid towards account of costs.
