Further to the announcement made on 28 November 2013, the Board of Directors of the Company wishes to announce that with regards to the legal suits from Orix which was fixed for hearing on 26 June 2014, Orix has filed their notice of withdrawal for application for leave to appeal to the Federal Court and as such the case has come to an end. However, on 26 June 2014 the Company received a letter of demand from Orix for payment for the sum of RM2,112,912.60 together with the interest thereon at the rate of 0.065% per annum calculated on a daily basis from 14 June 2014 till date of full settlement. The Company has been advised by the their solicitors on 26 June 2014 that Orix has withdrawn their Application for Leave to Appeal in the Federal Court and the demand is in respect of the same claim made by Orix in Johor Bahru High Court Civil Suit No.22-219-2009 which was dismissed by the High Court on 9 January 2012 after Full Trial and the dismissal was upheld by the Court of Appeal on 27 November 2013 and therefore the principle of res judicata would apply to estop Orix from reasserting and relitigating the claim.
