The Board of Directors of SBGB wishes to announce that Standard Confectionery Sdn Bhd (“SCSB”), a wholly-owned subsidiary of SBGB, has on 27 September 2012 been served with a Shah Alam Magistrates Court Summons No: 07(K)189-09/ 2012 in relation to charges under Section 43(2) of the Employees Provident Fund Act 1991 for failure to pay contributions required to be made to the Employees Provident Fund (“EPF”) on behalf of its employee, namely Abd Rashid Bin Mohd Esa @ Md Isa of RM1,776.00 for the months of January and February 2012. The charges for non-payment of EPF contributions are in relation to the period before the discovery of the financial irregularities. The Company has been in discussions with EPF to pay the outstanding EPF contributions by way of instalments. The Company is advised that the Plaintiff is restrained from commencing or further proceeding with the said suit without leave of the Court by virtue of and in accordance with the restraining order pursuant to Section 176(10) of the Companies Act, 1965, which was granted by the High Court in favour of SCSB on 14 August 2012. The Company is also currently seeking legal advice with regards to the said summons.
