Reference is made to the Company’s announcement dated 23 May 2013. The Board of Directors of Genetec wishes to announce that Genetec had on 13 July 2013 received the following papers from its solicitors in the United States of America (“USA”) via email, who received the following papers on 12 July 2013 from the Defendants’ registered agent in USA, National Registered Agents, Inc. (“NRA”). NRA had received the following papers on 12 July 2013 from the Plaintiff’s solicitors, N. Ward Lambert of Messrs Harper, Lambert & Brown, P.A.: 1. Notice of Motion and Motion of Entry of Default Judgment as to Defendants Systems South, Inc. and Genetec Technology Automation, Inc. ; 2. Affidavit of Default as to
Defendant Systems South, Inc.; 3. Affidavit of Default as to
Defendant Genetec Technology Automation, Inc; and 4. Draft Order of Judgment as to
Defendants Systems South, Inc. and Genetec Technology Automation, Inc. (collectively referred to as “Motion Notice”). The Plaintiff moves the Court for an Order adjudging the Defendants to be in fault for failing to file a responsive pleading or otherwise plead or appear within the time required by law of South Carolina and for entry of Default Judgment against the Defendants, based on Verified Complaint by the Plaintiff, which pleads its right to the sum of USD101,011.49. The Plaintiff will be entitled to the relief sought if no objection is filed by the Defendants within 10 days from the date of service of the Motion Notice. Genetec is of the opinion that the maximum expected losses from the Default Judgment, if any, is USD101,011.49 (equivalent to RM313,135.62) against the Defendants. The claim has no reasonably foreseeable material financial and operational impact on the Genetec Group, as the businesses and operations of the Defendants are managed independently from the Malaysian businesses and operations, and neither Defendant is a major subsidiary of Genetec. The Company is seeking advice from its solicitors in the USA regarding the Motion Notice. Further announcements will be made as and when there are material developments in the matter.
