Description | COUNTRY HEIGHTS HOLDINGS BERHAD ("CHHB" or "THE COMPANY") -INVOLVEMENT IN LITIGATION-HIGH COURT OF MALAYA, SUMMON NO. S21-19-2010 (GOVERNMENT OF MALAYSIA VS CHHB) |
Further to the writ of Summon No. S21-19-2010 and statement of claim by the Government of Malaysia and our announcement dated 8 February 2010, the Government of Malaysia (“Plaintiff”) has filed a claim against the Company for RM22,617,311.49 for Real Property Gain Tax for the years of assessment 1993, 1998 and 1999 together with interest at 8% thereon. The High Court dismissed CHHB 's Order 14A application for determination of a point of law in this connection . A Notice of Appeal and Application for stay of proceedings was filed and served. CHHB’s Stay Application and Appeal was dismissed with cost. Subsequently, an appeal was filed to appeal before the Special Commissioners of Income Tax against the Real Property Gain Tax assessments raised by Inland Revenue Board (“IRB”) for the years of assessment 1993, 1998 and 1999. The hearing was fixed on 16th and 17th October 2012. The appeal proceeded on 16th and 17th October 2012 and the Special Commissioners has directed the Inland Revenue Board to file a written submission by 23 January 2013 and CHHB to file a written submission by 25 February, 2013. CHHB intends to pursue the appeal against the said real property gains tax assessments as they have been raised on CHHB who is the acquirer of assets and not the disposer of assets. CHHB is of the view that the assessments have been raised unlawfully and are on the wrong party . The Plaintiff has filed a summary judgment application and the same was fixed for hearing on 12 December 2012. The Court has fixed 21 December 2012 for clarification/decision of the Plaintiff’s application for summary judgment. The Board wishes to announce that on 21 December 2012, the Court allowed the Plaintiff’s Summary Judgment application. CHHB will file an appeal with the Court of Appeal as well as seek a stay of execution of the judgment. In the event that the appeal against the assessments is finally determined in favour of the IRB and/or an appeal against the summary judgment or for the stay of execution is unsuccessful, CHHB is in possession of tax retention sum amounting to RM11,214,000.00 which can be used to settle the claim. The balance RM11,403,311.49 would need to be paid by CHHB. This announcement is dated 21 December 2012. |
