Contents: In our Announcement dated 23rd November 2010, we submitted our Quarterly Report on Consolidated Results for the Financial Period Ended 30/9/1010 ("Quarterly Report"). We had reported in detail the status of the litigation with EGM in the Quarterly Report.
In summary, the JV Company claimed YTL 5 Million (equivalent to RM 10,068,500.00) for the unlawful termination of the Agreement. However, EGM presented a counter claim, claiming approximately YTL 5.25 million from the JV Company seeking to return all the hardware and equipment to the JV Company in exchange for a refund of YTL 5.25 million (equivalent to RM 10,571,925.00) paid to the JV Company ("Lawsuit no. 2009/383"). This lawsuit reference number is assigned by the Ankara Court. It's cited here to indicate the applicable claim/case as well as for easier future follow-up updates.
We updated in our Quarterly Report that the Ankara Court appointed three expert witnesses on the 5th of October 2010 for them to study and analyze the case and the submissions of both Parties on commercial and technical grounds since the case is highly technical in nature. The Ankara Court then fixed 23rd December 2010 to hear the reports from the specialists or expert witnesses before giving out further directions.
However, the expert witnesses did not deliver the report on their findings or analysis of the case yesterday (i.e. 23rd December 2010). The Ankara Court then decided to fix a new hearing date of 24th March 2011 to hear the report from the expert witnesses.
