Contents: The Board of Directors of AKN, wishes to update the status of the debts from related party transactions (which have been outstanding for more than 12 months and which have not been fully settled) as follows:-
(i) The total outstanding from related party trade receivables as at 31 May 2010 is detailed in the table per Appendix I attached hereto.
(ii) Steps taken or proposed to be taken to recover the related party receivables
The company is in negotiations with Senzpak (M) Sdn Bhd ("Senzpak" ) and MEMS Technology Bhd ("MEMS") to recover the said debts. Both MEMS and its subsidiary Senzpak were granted a Restraining Order (RO) for a period of 90 days effective from 22 January 2010 by the High Court of Malaya at Kuala Lumpur pursuant to Section 176(10) of the Companies Act,1965 ("Act").
On 22 July 2010, MEMS announced that it had obtained a further extension of the RO pursuant to Section 176(10) of the Act for a period of 90 days effective from 30 July 2010 by the High Court. In addition, MEMS has also obtained an extension of time from the High Court to convene meetings with its creditors and members in relation to its regularisation plan pursuant to Section 176 (1) of the Act until 19 October 2010.
Senzpak still have machineries worth several millions in our premise and we hope to negotiate a proper and full settlement.
The Company is expected to recover the said debts within the next 15-21 months, following the announcement made by MEMS of their performance review under Note 13 of the unaudited interim financial results for the quarter ended 30 April 2010, whereby MEMS Group has resumed its operation for Johor and Singapore plants. In addition, MEMS is currently working on its regularisation plan for submission to Bursa Securities.
