Further to the announcements dated 18 April 2012, 28 May 2012 and 4 January 2013 pertaining to the arbitration proceedings between Bauer vs ECSB, we were informed by our Solicitor on Monday 3rd March 2014 that the Kuala Lumpur High Court (vide Kuala Lumpur High Court (Civil Division) Suit No. 22-NCVC-178-2011) granted Judgment in favor of Bauer (M) Sdn Bhd (Bauer) (Plaintiff) against Embassy Court Sdn Bhd (ECSB) (1st Defendant) and Magna Prima Berhad (MPB) (2nd Defendant). The relief granted in favor of Bauer against ECSB and MPB are as follows:- (a) An order for specific performance against the 1st Defendant (ECSB) requiring the 1st Defendant(ECSB) to produce a corporate guarantee issued by the 2nd Defendant (MPB) based on the terms of the draft corporate guarantee as provided by the Plaintiff (Bauer) or on such terms deemed appropriate by this Honourable Court; (b) An order that the 2nd Defendant (MPB) to indemnify and/or pay the Plaintiff (Bauer) such monies that are determined by the arbitrator to be said to be payable by the 1st Defendant (ECSB) to the Plaintiff (Bauer); (c) Costs; (d) Interest. We have instructed our Solicitors to Appeal against the decision of the Kuala Lumpur High Court. A Notice of Appeal was filed today (10th March 2014) by our solicitors.
