The Board of Directors of MPCORP wishes to announce that on 16 August 2013, the Plaintiff, a Management and Maintenance Body (“JMB”) of Wisma MPL had served an Originating Summons on the Company seeking inter alia the following reliefs:-
(b) the Defendant shall cease to operate the Car Parks and the Plaintiff shall be entitled to operate the same via its agents and/or servants; and (c) all monies and income derived from the operation of the Car Parks since the formation of the Plaintiff on 5 April 2008 until the handing over to the Plaintiff shall be paid into the Building Management Fund. The Company has been advised by its legal counsel that it has a reasonable prospect of success in defending the Plaintiff’s claim. The financial and operational impact of the claim on the Company cannot be measured until further particulars are furnished by the Plaintiff in the suit. But, the Company will do its best to mitigate the losses. If such a case arises, the Company will take appropriate steps to counter-claim any damages and losses from the third party or parties and be indemnified for any losses arising out of the loss of ownership of the Car Parks. The Kuala Lumpur High Court has fixed the case for case management on 3 September 2013. Further announcement on any material development will be made as and when necessary.
