Contents: MTD Capital Bhd ("MTD" or "the Company") wishes to announce that the legal counsels of MTD Manila Expressways, Inc., a wholly-owned subsidiary of MTD had received the Temporary Restraining Order ("TRO") dated 13 August 2010, issued by the Supreme Court, Manila, Republic of Philippines. The TRO restrained the toll rate increases in South Luzon Expressway ("SLEX"), effective immediately and continuing until further orders from the Supreme Court.
The TRO was issued on the basis of the filing of: (a) a petition for prohibition and mandamus with prayer for the issuance of a temporary restraining order and/or writ of preliminary injunction to enjoint the implementation of the new toll rate at the SLEX, filed by Joey Sarte Salceda, which was docketed as G.R. No. 192484 before the First Division of the Supreme Court (the "Salceda Petition"), and (b) a Motion for Leave of Court and/or to Admit Supplemental Petition filed by Ernesto B. Francisco, Jr. (the "Francisco Supplemental Petition") in the existing case docketed as G. R. No. 166910. The Salceda Petition is filed against the Toll Regulatory Board (TRB), the South Luzon Tollway Corporation (SLTC) and the Manila Toll Expressway Systems. Inc. (MATES). The Francisco Supplemental Petition seeks to implead SLTC and MATES as parties in the existing G.R. No. 166910, which was earlier filed against the TRB, MTD Manila Expressways, Inc., the Philippine National Construction Corporation and the respective concession holders of the South Metro Manila Skyway System and North Luzon Expressway toll road concessions.
The Supreme Court consolidated the Salceda Petition with the Francisco Supplemental Petition.
The Supreme Court has likewise issued separate Orders for the respondents to file their respective Comments to the Salceda Petition and the Francisco Supplemental Petition.
