The Board of Directors of MAXBIZ wishes to inform that a Winding Up Petition dated 11 June 2010 ("the Winding Up Petition") was presented to the High Court of Malaya at Kuala Lumpur against M.K.K. Industries Sdn Bhd, a wholly owned subsidiary of MAXBIZ.
On 28 June 2010, the Winding Up Petition was served on M.K.K. Industries Sdn Bhd by Intertrad Limited T/A Sclavos International's Solicitor.
Intertrad Limited T/A Sclavos International commenced a suit against M.K.K. Industries Sdn Bhd and Inno-Option Sdn Bhd, inter alia, for:
- the sum of USD658,174.56 as at 29 March 2008, the sum of USD174,817.08 being interest at the rate of 7% per annum on overdue amount from 28 April 2004 to 29 March 2008,
- interest at the rate of 7% per annum on the sum of USD658,174.56 from 30 March 2008 to date of judgment and interest at the rate of 7% per annum from date of judgment to date of full settlement,
- costs; and
- such further and other just relief the Honourable Court deems fit.
On 30 December 2008, Intertrad Limited T/A Sclvaos International obtained a judgment in default of defence against M.K.K. Industries Sdn Bhd for the abovementioned claims and the costs of RM225.00.
Subsequently, M.K.K. Industries Sdn Bhd filed an Application to set aside the Judgment in default of Defence and the same was fixed for decision on 12 April, 2010 and on the same date the Senior Assistant Registrar dismissed M.K.K. Industries Sdn Bhd's Application with costs.
Thereafter, on 16 April 2010, M.K.K. Industries Sdn Bhd filed an Appeal to the Judge in Chambers against the Senior Assistant Registrar's decision ("M.K.K. Industries Sdn Bhd's Appeal to the High Court Judge").
The Court has fixed 9 August 2010 for hearing in respect of the M.K.K. Industries Sdn Bhd's Appeal to the High Court Judge.
MAXBIZ does no foresee any no financial and operational impact of the Winding Up Proceedings on the Group.
Losses expected from the Winding Up Petition will be aproximately USD660,000.00.
MAXBIZ will seek necessary legal advice from its solicitors with regard to the claims and it is also part of the investigation of Ferrier Hodgson MH Sdn Bhd.
MAXBIZ will announce further development on the above matter as and when necessary.
