A writ of summon [“said Writ”] was filed on 7.8.2014 by certain natives of Sabah [“Plaintiffs”] claiming rights over all those 113 parcels of lands, all situated in Kampung Natu, District of Kota Marudu, Sabah [“said Lands”] in the High Court in Sabah and Sarawak at Kota Kinabalu vide suit no. BKI-22NCvC66/8-2014 (HC2) [“said Suit”] naming one Hatija Binti Hassan as first defendant, one Juniah @ Rubiah Bt. Okk Zainal as second defendant and Pelipikan Plantation Sdn Bhd (Company No. 332468-P) [“PPSB”] as the third defendant. PPSB, the Company’s wholly-owned subsidiary, is the registered sub-lessee of the said Lands. Acting on the authority of the Power of Attorney P/A No. 5391/03 (the “said PA”), one Sikit @ Lanjim bin Sarapong [“Sikit”] transferred the said Lands on behalf of the Plaintiffs to the first and second defendants and they created a sublease on the said Lands in favour of PPSB. The Plaintiffs alleged that both the said transfer and sublease are null and void by reason of the lack of authority on the part of Sikit to lawfully deal with the said Lands. The Plaintiffs are claiming for, amongst others, the following: (a) a declaration that the Plaintiffs are entitled to possession of the said Lands; (b) a declaration that the Plaintiffs are entitled to the legal and beneficial ownership of the said Lands; (c) a declaration that the transfer of the said Lands to Sikit by the Plaintiffs be declared null and void; (d) an order directing the defendants to give vacant possession of the said Lands to the Plaintiffs; (e) an order directing the Assistant Collector of Land Revenue, Kota Marudu, Sabah to remove and delete forthwith the registration of the transfer of the said Lands; and (f) an order directing the Assistant Collector of Land Revenue, Kota Marudu, Sabah to remove and delete forthwith the registration of the sublease of the said Lands in favour of the third defendant.
