Further to our announcement dated 17 July 2012, KHSB wishes to announce further development on the above case involving SAP Holdings Berhad (“SAP”), a wholly-owned subsidiary of the Company. The solicitor acting for SAP informed that during the Hearing fixed on 14 May 2013, the Learned Judge granted Order in Terms as follows: 1) For Inter-Parte Interim Injunction - the Court had allowed SAP’s application to restrain the Defendant from filing winding-up petition under Section 218 of the Companies Act, 1965 until the disposal of the Originating Summons filed by SAP. 2) For Originating Summons –
(b) declaration that the amount claimed is unfair, unreasonable, exorbitant and SAP is not liable to pay for the same; (c) the Defendant to issue a new Bill of Costs to the right entity within ninety (90) days with due justification and details; (d) thereafter, the new Bill of Costs to be submitted for taxation before the Registrar. The Company will make the necessary announcement on further development on this matter in due course. This announcement is dated 21 May 2013. | |
