The particulars of the Counterclaim by the 2nd Defendant were as follows:- (a) The 2nd Defendant alleged that the 2nd Defendant’s credit facilities from Alliance Islamic Bank for the sum of RM50 million were revised and reduced due to the commencement of the Suit; (b) The 2nd Defendant further averred that the aforesaid reduction of the credit facilities had caused the 2nd Defendant to suffer losses and loss of profit whereby its business is affected by the said revision; (c) By reason of the above paragraphs 1(a) and (b), the 2nd Defendants claims against the Plaintiffs for: (i) RM37.6 million being the differential sum of the revised loan to be paid forthwith by the Plaintiffs from the date of the judgment; (ii) Interest on the said sum of RM37.6 million at the rate of 5% per annum from 10.5.2013 until full realisation; (iii) RM254,220-69 being the losses on the legal fees and stamp duty to be paid forthwith by the Plaintiffs from the date of the judgment and interest at the rate of 5% per annum thereof; (iv) Loss of profit and general damages to be assessed and interest at the rate of 5% per annum thereof; (v) Costs; and/or (vi) Any further and/or other orders the Court deems fit and/or otherwise appropriate. 2. Hiap Teck Venture Berhad has been advised by its solicitors from the facts of its case that, the Plaintiffs have a good claim and a good defence to the 2nd Defendant’s counterclaim and does not expect any losses as the Plaintiffs’ claim is based on valid grounds whereas the Defendants’ Defence and the 2 nd Defendant’s Counterclaim are baseless and do not have any merit. Therefore, the alleged RM37.6 million and RM254,220-69 claimed by the 2nd Defendant is not expected to have material financial impact or operational impact to HiapTeck Venture Berhad. 3. Steps to be taken by Hiap Teck Venture Berhad in respectof the Defendants’ Defence and Counterclaim:- (a) Hiap Teck Venture Berhad will obtain necessary legal advice from its solicitors and will issue reply to the Defence of the Defendants and Defence to the Counterclaim of the 2nd Defendants on or before 10 June 2013. The Suit has been fixed by the Court for further Case Management on 10 June 2013. Further announcement on the subsequent material developments of the above Suit will be made as and when appropriate.
