Pursuant to Clause 4.1 of the MOU, the term of the MOU has expired on 16 November 2012. Despite extensive negotiations and discussions, both parties were unable to agree on the commercial terms of the final proposal. As such, KHSB no longer wishes to pursue with the MOU. The Court has vacated the Trial date on 19 November 2012 and fixed a new date for Trial on 25 January 2013 to enable the parties to comply with the Court’s directives given on 5 November 2012.
